- The Government of India launched the National Rural Employment Guarantee Act (NREGA), 2005 in September 2005. Rights and Entitlements Under the Employment Guarantee Scheme
Rights and Entitlements:
- Every adult member whose name appears on the Job Card can request unskilled manual work.
- All registered household members can apply for employment under the Scheme for as many days as they desire, with a cap of one hundred days per household in a financial year.
- If an applicant does not receive work within 15 days of submitting their application, or from the date they requested work in the case of advance applications, they can claim a daily unemployment allowance. This allowance will be at least one-fourth of the wage rate for the first 30 days, and at least one-half of the wage rate for the remaining days of that financial year.
- Efforts will be made to provide work within the applicant’s village. If employment is offered beyond a five-kilometer radius from their village, they will receive an extra 10% of the wage rate to assist with additional transport and living expenses.
- Women will be given priority for job opportunities, ensuring that at least one-third of the wage seekers are registered women who have applied for work.
- If wage payments are delayed beyond fourteen days, workers will be entitled to compensation as per the Payment of Wages Act, 1936 (4 of 1936) or any applicable local laws.
- No discrimination based on gender will occur, and the equal pay provisions of the Equal Remuneration Act, 1976 (25 of 1976) will be strictly enforced.
