The Epidemic Diseases Act, 1897

This is Act no. 3 of 1897. This was enacted by Imperial Legislative Council and now the powers rest with the Parliament of India.

During the bubonic plague in Mumbai in the late nineteenth century, the act was enacted for the containment of epidemics to control the spread of diseases.

PREVENTION OF OUTBREAK OF THE DISEASE(STATE GOVERNMENT)

As concluded by the state government that as on the breaking up of any epidemic disease in the state and the running laws are incapable for supervising the threat then the administration may by public notice with certain rules to be followed by each individual shall deem mandatory to prevent the epidemic arising in the state.

PREVENTING MEASURES (CENTRAL GOVERNMENT)

If any part of India is suffering from any epidemic disease then to prevent so the government may take steps to ensure the detention of any ship or vessel arriving at the port.

IF ANYTHING UNDER THE ACT IS DONE FOR GOOD FAITH THEN NO SUIT SHALL LIE AGAINST THAT PERSON.

PENALTY

Under section 188 of the Indian Penal Code, an individual will be punishable for disobedience of any regulation under the act. This penalty is applied to each citizen of India.
