Key Provisions of the Sexual Harassment of Women at Workplace Act

Complaint of sexual harassment. For the purpose of sub-section (2) of Section 9,-

For an aggrieved woman who cannot file a complaint because of physical incapacity, a complaint can be submitted by:
1. Her relative or friend; or
2. Her co-worker; or
3. An officer from the National Commission for Women or the State Women’s Commission; or
4. Any person who is aware of the incident, with the written consent of the aggrieved woman;
If the woman is unable to complain due to mental incapacity, a complaint may be filed by:
1. Her relative or friend; or
2. A special educator; or
3. A qualified psychiatrist or psychologist; or
4. The guardian or the authority responsible for her care or treatment; or
5. Any person with knowledge of the incident, along with her relative or friend, or special educator or qualified psychiatrist or psychologist, or guardian;
If the aggrieved woman is unable to make a complaint for any other reason, anyone who knows about the incident can file a complaint, provided they have her written consent;
If the woman has unfortunately passed away, a complaint can be submitted by any person with knowledge of the incident, with the written consent of her legal heir.
