2. Application

(i) These orders are applicable to Government servants, including State Government servants who are on deputation to the Central Government, and industrial employees who directly work under the Government. This includes civilians whose pay falls under civil estimates or those paid from Defence estimates. However, these orders do not apply to-

(a) Railway servants,

(b) Casual, daily wage, ad-hoc, or part-time employees,

(c) Individuals paid from contingencies,

(d) Contract workers, unless the contract states otherwise, and

(e) India-based staff serving in Missions abroad, who receive educational assistance under the Indian Foreign Service (Pay, Leave, Compensatory Allowances, and other conditions of service) Rules, 1961, which may be updated from time to time.

(ii) These orders also apply to Government servants on deputation to State Governments or engaged in foreign service, as long as there is a specific mention of educational assistance in the terms of their deputation or foreign service.

Definitions Related to Tuition Fee Reimbursement

3. Definitions

In these orders, unless the context indicates otherwise:-

(a) ‘Child’ refers to a child of a Government servant and includes step-children and adopted children who are fully dependent on the Government servant;

(b) ‘Government’ refers to the Central Government;

(c) ‘Head of Office’ is defined as a gazetted officer as per rule 4 of the Delegation of Financial Power Rules, 1978, and includes any other person specified by the competent authority;

(d) ‘Higher Secondary or senior secondary classes’ include classes XI and XII, along with equivalent classes under the 10+2+3 scheme, such as Pre-university or first-year classes of an Intermediate College, a technical College, or a polytechnic, provided the child has passed the Secondary examination but not the Higher Secondary Examination before joining that class;

(e) ‘Primary classes’ are classes I to V and do not include kindergarten or nursery classes;

(f) ‘Recognised School’ refers to a Government school or any educational institution recognized by the Central or State Government, or Union Territory Administration, including those not receiving government aid. Education up to the Senior level is regarded as school education for these orders;

(g) ‘Secondary classes’ mean classes VI to X;

(h) Tuition Fee means the amount payable and actually paid, which includes-

(i) Science fee,

(ii) Laboratory fee, if science fee is not separately charged,

(iii) The special fee for agriculture as an elective subject, and

(iv) Any fee for subjects like music that are part of the regular school curriculum or require practical work as per the work experience program.

However, for claims, if a science student pays a higher tuition fee than a non-science student, the science fee will not be included separately in the tuition fee.

Explanation-

Tuition fee’ does not cover-

(i) domestic science fund charges,

(ii) Library fee,

(iii) Games fee,

(iv) Admission fee, and

(v) Extra-curricular activity fee.
