Model Tenancy Act 2021 has been approved by the Union Cabinet, chaired by Prime Minister Shri Narendra Modi, for circulation to all States / Union Territories for adaptation by way of enacting fresh legislation or amending existing rental laws suitably.

It will help overhaul the legal framework with respect to rental housing across the country, which would help spur its overall growth.

Model Tenancy Act 2021 – Main Objective

The Model Tenancy Act aims at creating a vibrant, sustainable, and inclusive rental housing market in the country. It will enable the creation of adequate rental housing stock for all the income groups, thereby addressing the issue of homelessness. Model Tenancy Act will enable institutionalization of rental housing by gradually shifting it towards the formal market.

The Model Tenancy Act will facilitate the unlocking of vacant houses for rental housing purposes. It is expected to give a fillip to private participation in rental housing as a business model for addressing the huge housing shortage.

Under the Model Tenancy Act, unless otherwise agreed in the tenancy agreement, the landlord will be responsible for activities like structural repairs except those necessitated by damage caused by the tenant, whitewashing of walls and painting of doors and windows, changing and plumbing pipes when necessary and internal and external electrical wiring and related maintenance when necessary.

On his part, a tenant will be responsible for drain cleaning, switches, and socket repairs, kitchen fixtures repairs, replacement of glass panels in windows, doors, and maintenance of gardens and open spaces, among others.

मॉडल टेनंसी एक्ट 2021

केंद्र सरकार द्वारा लाए गए इस आदर्श किराया कानून या टेनंसी एक्ट (Model Tenancy Act) के तहत मकान मालिक (Landlord) और किराएदारों के बीच मतभेद को कम होगा। इस कानून के तहत खाली घर किराये पर चढ़ाए जा सकेंगे, घरों की कमी दूर होगी और प्राइवेट प्लेयर्स को बिजनेस भी मिलेगा और अगर किरायेदार दो महीने तक मकानमालिक को किराया नहीं देता तो उससे घर/जगह खाली कराई जा सकती है।

किरायेदार को सुविधा : इस कानून के तहत अगर मकान मालिक किराये के घर में रिपेयर से जुड़े काम करना चाहता है तो उसे  किरायेदार  को 24 घंटों का लिखित नोटिस एडवांस देना होगा। रेंट एग्रीमेंट (Rent Agreement) के हिसाब से किरायेदार को घर से मकान मालिक नहीं निकाला सकता।

सिक्योरिटी डिपाजिट में कितनी रकम : किराये पर घर लेने के मामले में सिक्युरिटी डिपॉजिट अधिकतम 2 महीने का किराया हो सकता है, जबकि नॉन रेसिडेंशियल जगहों के लिए अधिकतम 6 महीने का किराया।

जगह खाली कराने का क्या है प्रावधान : अगर मकान मालिक ने रेंट एग्रीमेंट (Rent Agreement) की सभी शर्त को पूरा किया है, फिर भी किराएदार जगह खाली नहीं करता है तो मकान मालिक दो महीने का किराया डबल कर सकता है। फिर भी खाली नहीं करने पर किराया दो महीने बाद चार गुना कर सकता है। जगह खाली करने के लिए मकानमालिक को पहले नोटिस देना होगा। मकान मालिक किराए वाले मकान या दुकान को खाली कराने के लिए नोटिस दे सकते हैं। इसके बाद एक दिन पहले लिखित में या मैसेज/मेल आदि के माध्यम से बताएं।

विवाद का निपटारा कहां होगा: मकानमालिक और किरायेदार के विवाद का निबटारा रेंट अथॉरिटी में होगा। रेंट अथॉरिटी (Rent Authority) बनने के बाद मकान मालिक और किरायेदार अथॉरिटी के सामने पेश होकर रेंट एग्रीमेंट करेंगे। दोनों पक्षों को एग्रीमेंट होने की तारीख से दो महीने के अंदर रेंट एथॉरिटी को सूचना देनी होगी। रेंट अथॉरिटी मकान मालिक और किरायेदार के बीच के संबंधों को स्पष्ट करेगी।
