As the matter of state land in Kashmir becomes increasingly urgent, the Jammu and Kashmir administration has instructed revenue officers to completely clear all encroachments from state land, including Roshni and Kahcharai, by the end of January. This directive from Vijay Kumar Bidhuri, the Commissioner Secretary Revenue, has been issued to all deputy commissioners in the Union Territory, even as multiple review petitions challenging the Roshni Act judgment are still pending in the High Court of Jammu and Kashmir and Ladakh.

Bidhuri has also outlined several guidelines aimed at effectively monitoring the anti-encroachment initiative. The list of encroachments includes many well-known figures in J&K, such as politicians from major political parties and influential businessmen who have acquired prime locations for very low prices.

The perks of regularization given to beneficiaries under the Roshni Act have now been revoked by the Division Bench of the J&K High Court, which was led by the then Chief Justice Gita Mittal, during the scrutiny of PIL No 19/2011 and related matters.
Initially introduced during the budget speech of 2000 by finance minister Abdul Rahim Rather from the NC, the Roshni Act saw amendments made by the PDP government led by the late Mufti Mohammed Syed, which changed the cut-off year to 2004. Subsequently, the Congress government, under Ghulam Nabi Azad, extended the cut-off year further to 2007.
A report from the Comptroller and Auditor General in 2014 revealed that only Rs 76 crore was collected from the transfer of encroached land between 2007 and 2013, in stark contrast to the target of around Rs 25,000 crore.
On Sunday, the All Jammu and Kashmir Panchayat Conference, which is made up of elected panchayat members, expressed its intent to protest collectively across the Union Territory against any “anti-encroachment” campaign aimed at reclaiming state land that has belonged to people for many years. 🚨
