The Disaster Management Act, 2005
The Government of India is employing the Disaster Management Act, 2005, as its strongest and only weapon in the midst of the critical war with COVID-19.
This is the first time that the Act has been used in response to a pan-India biological crisis.
Features Of The Disaster Management Act, 2005
- The law mandated the establishment of the National Disaster Management Authority and state disaster management authorities as agencies responsible for crisis risk and response reduction at the national and state levels, respectively.
- The Ministry of Internal Affairs’ Disaster Management Division remained in charge of overall disaster response coordination. And he directed the Ministries and Agencies involved to develop their own plans in line with the National Plan.
- Financial processes, such as the formation of funds, the National Disaster Mitigation Fund, and equivalent funds at the state and district levels, are also covered by the Act.
Criticism Of The Act
Non-governmental organizations (NGOs), elected local officials, local communities, and civic groups have been attacked for being marginalized by the act. It promotes a hierarchical, bureaucratic, command-and-control, ‘top down’ strategy that gives wide powers to the federal, state, and local governments.
