The Minimum Wages (Central) Rules, 1950

The Minimum Wages Central Rules, 1950, establish minimum wage rates in particular occupations listed in the schedule.

The Delhi Government follows the Minimum Wages Central Rules, 1950, to ensure that the Minimum Wages Act, 1950 is administered and monitored effectively.

Disqualification of Minimum Wages

A person shall be disqualified from being nominated for and serving on, the Committee, Advisory Committee, or Board, as the case may be if the following conditions are met:

• if a competent court declares him incompetent to stand trial.
• if he is an insolvent who has not been discharged.
• if he was convicted of a crime involving moral turpitude before or after the Act’s enactment.
• If there is any doubt as to whether disqualification has been obtained under sub-rule (1), the Central Government’s judgment is definitive.

Applicability of Minimum Wages

The Act covers all schedules of work when minimum wages are set/revised. – Under this Act, every employer must pay the minimum wage for the planned employments. There is a provision for setting work hours, overtime, and overtime pay. – Variable DA is set based on the prior calendar year’s Consumer Price Index. – On the guidance of the State Level Minimum Wages Advisory Committee, minimum wages are set in Delhi.
