Farmers Bill 2020 (Empowerment & Protection)

This Bill replaces the Farmers (Empowerment and Protection) Agreement of Price Assurance and Farm Services Ordinance, 2020. Therefore, please refer to our legislative brief on the Agriculture Ordinances, 2020.

Main provisions –

  • The new legislation will empower farmers for engaging with processors, wholesalers, aggregators, wholesalers, large retailers, exporters etc., on a level playing field. Price assurance to farmers even before sowing of crops. In case of higher market price, farmers will be entitled to this price over and above the minimum price.
  • It will transfer the risk of market unpredictability from the farmer to the sponsor. Due to prior price determination, farmers will be shielded from the rise and fall of market prices.
  • It will also enable the farmer to access modern technology, better seed, and other inputs.
  • It will reduce the cost of marketing and improve the income of farmers.
  • An effective dispute resolution mechanism has been provided with clear timelines for redressal.
  • The impetus to research and new technology in the agriculture sector.

Doubts –

  • Under contract farming, farmers will be under pressure and they will not be able to determine prices
  • How will small farmers be able to practice contract farming, sponsors will shy away from them
  • The new system will be a problem for farmers
  • In case of dispute, big companies will be at an advantage

Clarification –

  • The farmer will have full power in the contract to fix the sale price of his choice for the produce. They will receive a payment within a maximum of 3 days.
  • 10000 Farmer Producer organizations are being formed throughout the country. These FPOs will bring together small farmers and work to ensure remunerative pricing for farm produce
  • After signing the contract, the farmer will not have to seek out traders. The purchasing consumer will pick up the product directly from the farm
  • In case of dispute, there will be no need to go to court repeatedly. There will be a local dispute redressal mechanism.

Highlights of the Ordinance

  • The Farmers’ Produce Trade and Commerce (Promotion and Facilitation) Ordinance, 2020 allows intra-state and inter-state trade of farmers’ produce beyond the physical premises of APMC markets.  State governments are prohibited from levying any market fee, cess, or levy outside APMC areas.
  • The Farmers Agreement Ordinance creates a framework for contract farming through an agreement between a farmer and a buyer prior to the production or rearing of any farm produce.  It provides for a three-level dispute settlement mechanism: the conciliation board, Sub-Divisional Magistrate and Appellate Authority.
  • The Essential Commodities (Amendment) Ordinance, 2020 allows the central government to regulate the supply of certain food items only under extraordinary circumstances (such as war and famine).  Stock limits may be imposed on agricultural produce only if there is a steep price rise.

Key Issues and Analysis

  • The three Ordinances aim to increase the availability of buyers for farmers’ produce, by allowing them to trade freely without any license or stock limit, so that an increase in competition among them results in better prices for farmers.  While the Ordinances aim to liberalize trade and increase the number of buyers, de-regulation alone may not be sufficient to attract more buyers.
  • The Standing Committee on Agriculture (2018-19) noted that the availability of a transparent, easily accessible, and efficient marketing platform is a pre-requisite to ensure remunerative prices for farmers.  Most farmers lack access to government procurement facilities and APMC markets.  It noted that small rural markets can emerge as a viable alternative for agricultural marketing if they are provided with adequate infrastructure facilities.
  • The Standing Committee also recommended that the Gramin Agricultural Markets scheme (which aims to improve infrastructure and civic facilities in 22,000 Gramin Haats across the country) should be made a fully funded central scheme and scaled to ensure the presence of a Haat in each panchayat of the country.

Key Features

The Farmers (Empowerment and Protection) Agreement on Price Assurance and Farm Services Ordinance, 2020

  • Farming agreement: The Ordinance provides for a farming agreement between a farmer and a buyer prior to the production or rearing of any farm produce.  The minimum period of an agreement will be one crop season or one production cycle of livestock.  The maximum period is five years unless the production cycle is more than five years.
  • Pricing of farming produces: The price of farming produce should be mentioned in the agreement.  For prices subjected to variation, a guaranteed price for the product, and a clear reference for any additional amount above the guaranteed price must be specified in the agreement.  Further, the process of price determination must be mentioned in the agreement.
  • Dispute Settlement: A farming agreement must provide for a conciliation board as well as a conciliation process for settlement of disputes.  The Board should have a fair and balanced representation of parties to the agreement.  At first, all disputes must be referred to the board for resolution.  If the dispute remains unresolved by the Board after thirty days, parties may approach the Sub-divisional Magistrate for resolution.  Parties will have a right to appeal to an Appellate Authority (presided by collector or additional collector) against decisions of the Magistrate.  Both the Magistrate and Appellate Authority will be required to dispose of a dispute within thirty days from the receipt of the application.  The Magistrate or the Appellate Authority may impose certain penalties on the party contravening the agreement.  However, no action can be taken against the agricultural land of the farmer for recovery of any dues.

    2.The Bill must have to take care about the pricing of the finished or end products, else the end-users may be exploited after certain point of time.
    3.Also, the empowerment of the Board at Village/Panchayet level should have been mentioned categorically. There may be the chances of interferences of ‘powerful’ person and/ or ‘political’ parties at village level.
    4. Since, the pricing of the produce will be fixed prior to sowing/ cultivation, what will be the remedy both farmer and the procurer in case the crop fails, or the yield is reduced.
    5. All contacts need to be renewed, considering the productivity as well as soil health under the strict vigilance of the Agricultural Officers.

    A good job done by the Govt. of Indidia.

  6. Jise bhi is “bill” me koi kami nazar aati ho vo thoda sa time nikal kar is bill ko ekk baar khud padh lijiye internet par vo bhi uplabdh hai, dusron ki baaton ko copy Karna aasaan bhale hi ho but isse aapki samajh me koi badlaav kabhi nahi aa sakta.

    Murkh banna ya na banna aapke upar hai. Aasaan tarike se bhed chaal me agar chalenge to murkh banne ka isse behatar tarika dusra shayad hi koi aur ho. 🙏

    2. Why are trying to make PAN Compulsory for trading?

    I FIND IT IS NOT AT ALL AGAINST THE FARMER IN THE SENSE THAT THE
    FARMER WILL GET THEIR DUE SUPPORT PRICE IN DUE TIME AFTER THE
    DELIVERY OF THE FARM PRODUCE TO THE SPONSOR .(OR THE PVT ENTITIES
    OR FOOD PRODUCTION COMPANIES FOR EXAMPLE HINDUSTAN LEVER
    KISSAN TAMATO KETCHEP P LTD ETC.
    WE HAVE TO THANK PM MODI AND HIS CABINET COLLEAGUES FOR HIS
    ENTERPRISING THOUGHT TOWARDS A MODERN INDIA WHICH EXISTS ALREADY BUT HAS TO MARCH FORWARD TOO IN ORDER TO BEAT GREAT GIANTS LIKE RUSSIA AND AMERICA .BUT ANOTHER THING WHICH MR.MODI SHOULD SEEK HERE IS THE RESERVATION FOR THE POOR AND NEEDY FOR A TWO ACRE LAND FOR CULTIVATION ALL OVER INDIA THUS
    PUTTING A GAG ON THE SO CALLED COMMUNISTS WHO PLAY A FARCE ROLE IN PROTECTING THE INTEREST OF THE POOR FARMERS. HE SHOULD SEE TO IT THAT ALL THE INDIAN POPULATION SHOULD BE PROVIDED A FARM LAND CONSISTING OF 2-5 ACRES SO THAT THEY SHOULD BE ABLE TO PRODUCE WELL AND IMPROVE THEIR STANDARD OF LIVING.

  10. Farmer needs only:
    1) minimum 12 hr quality current per day (3 phase) . As in 70 % area 3 phase current will be available in night only. Where as in industrial area / city area 24 hr quality power supply is there.
    2) Water – this is not in government hand but government needs to think and develop plans for better. Not to put dummy dams with no result.
    3) Price – considering the maintance and crop cost price shall be decided. (now a days there is no price control on fertilizer / pesticide / manpower / seeds)

    Now a days farmer can sell there crop anywere in India. Only existing laws needs to be ammend sliglty.
    Don’t buy Kisan freedom.
    There is no requirement of farmer bill 2020 as our base is weak.
    Don’t involve corporatores in agriculture.

    Non farmers requested, not to give hopothetical views which is miss guiding the people. Only farmer know there actual problem and let them decide.

The only concerns that farmer’s were worried about was the contract farming and MSP and there demands were genuine and could be resolved at the earliest and easily but now this has been dragged too much and my opinion is that what I felt even the Kisan union leaders are deliberately disinforming the farmers. And this protest has been hijacked but ofcourse its the responsibility of everyone including the current govt. to look into the affairs.

  12. Dear sir,
    What if a farmer doesn’t want to go for contract farming ?
    In that case where would he sell his produce when the Mandis will cease to exist ?
    He can not take his produce to other city or state. The business company may decline to purchase his produce as he had not entered in the agreement. The company may force the farmers to enter the agreement.
    Why the contract farming is being pushed so much. ? Why can’t I have the better price , a guaranteed price without entering in this agreement?
    Why the govt. can’t eliminate the middlemen from the Mandis and make sure that farmers get their dues fairly. Why is it so that only corporate can do this ? Why the govt can’t assure farmer’s security at the Mandis?
    What if the quality (as so impressed in the bill), of the produce does not comply with the standard as laid down in the agreement. What will happen then ?
    Please answer if you have understood these points, so that I could also understand the implications and if so then might make someone else too.

This bill is misinterpreted by many, and farmers are being led into an army by a bunch ppl who were mis-using the assets of farmers…even if corporates will come into picture what’s bad with this? Only thing to watch for will be the transition period and the manipulation that will come into picture as an ordinary farmer may not understand the miniscules there…definitely turmoil is and will be there..but it will be settled only if the agenda is not steered away as we have seen in the recent days…But yes..there will be downside too (less) compared to upside(more).

  17. Many farmers are already doing contract farming. it is not compulsory. It is being formalized with this bill. Those farmers who don’t want to do are free not do contract farming. Mutual Agreement Farming.

  19. Point out the wrong points in the bill. just think. watch videos which talk about the bill and not the feeling about the bill. No opposition will talk about what is wrong in the bill. Govt’s job is to come up with the bills. opposition is for pointing out what is wrong in the bill and can be improved so bill can serve its purpose.

  21. kisaan union leaders are support the farmers and see for their welfare. They possibly have no ulterior motive to mislead the entire farming population and moreover if the government had consulted the persons for whom the laws are passed, perhaps this situation would not have arisen, and the way the bills were passed in the parliament in such chaos and hurry seems to add on the reason why they would not be approved otherwise because they increase the chances of exploitation of poor farmers. We are not a capitalist society and shouldn’t act like one the first priority of the government is to look after it’s people. moreover, this model failed in bihar and had adverse effects on the farming population in america, shouldn’t we be learning from the mistakes……….. 😐 how stupid can people be

  24. As i Understood there are some query in the bills
    1. It is a waiver of “MANDI” technique. If the farmers do not corporatise the farming. Why central Govt.does not take over the MANDIS control ?

    2. What will be the price machanism of product for the end users ? Is there a chance of price rising ?
    3.Our judiciary system of our country is very lengthy , if any dispute arises , is it possible to survive the small farmers till the dispose of disputes ?

  25. If really want to grow country and Farmers, expects to lead decent life, we must not dependent on existing Acts which opposition wanted before, opposing now. We are spending 15k to 20K per acre to produce Paddy, finally not even getting break even, forget about profits. Govt at least trying to take dare step, If really Opposition oppose this act, they need to tell what is the exact problems and any recommendations. Just provoking the innocent people to protect and these politicians and Mediators enjoying under the roof with proper security will not work
